Modern generative artificial intelligence tools like ChatGPT, Google Gemini, Sora, Midjourney, Github Copilot, and Claude, raise many complex questions under copyright law. In this workshop, I will explore two important developments in this space. First, I will dig into the newly published study from the United States Copyright Office on the copyrightability of generative AI outputs. Then I will discuss a recent case involving the legal research database, Westlaw, and whether training an AI tool on copyrighted works constitutes fair use.
