The question of whether training artificial intelligence models on copyright protected works constitutes copyright infringement or fair use is one of the biggest -- and thorniest -- issues about how copyright law applies to AI today. On May 9, 2025, after nearly 2 years of work, the United States Copyright Office published its analysis of this issue as part of its study on AI and copyright. While it is unclear what impact this "pre-publication" report will have on the 40+ cases looking at this issue in courts across the country, it nevertheless offers an important perspective on this tricky question. In this workshop, we will investigate the new copyright office report and speculate on what it may mean for the development of copyright law.
